Terms and Conditions Agreement

1.

Scope of application:

1.1

The following general terms and conditions govern the contractual relationship between the transport and logistics service provider, MOROCCAN TRANS SERVICES LLC, as the contractor and its customers, in short the sender or the customer. Unless otherwise agreed, the following terms and conditions shall apply.

1.2

By placing the order, the customer agrees to these terms and conditions.

2.

Offer and conclusion of contract:

2.1

A contract is concluded when the customer signs the order confirmation. Only written offers of the contractor are binding, telephone or offers by e-mail are not binding.

3.

Form of declarations:

3.1

Legally relevant declarations and notifications that the client has to make to the contractor or a third party must be in writing.

4.

Packaging conditions:

4.1

Secure packaging is essential for all shipments regardless of contents, except for items that can be transported unpackaged.

4.2

The packaging must be designed to provide sufficient protection for the contents of the shipment and to protect against loss or damage.

4.3

Out of consideration for the health of our employees, special labeling is required for packages weighing over 20 kg.

4.4

Bottles and containers with liquid contents must be tight so that the liquid cannot escape. This prevents other customers' shipments from being damaged or smeared.

5.

Unfree shipping:

5.1

Consignments can be delivered freight collect and payment of the fee will be claimed from the recipient. However, if the recipient refuses to pay and therefore refuse to accept the package, the package will be returned to the sender and the shipping costs will then be invoiced.

6.

Information on data protection:

6.1

Information about the sender and recipient is used by MOROCCAN TRANS SERVICES LLC exclusively to fulfill the transport contract and for customs clearance on the basis of the legally applicable regulations. As part of this transport contract, this information will be made available to the customs authorities in the country of destination and the cooperating delivery partners. The information can be transmitted in paper or electronic form.

7.

Exclusion and prohibited goods:

7.1

When handing over his shipment, the sender is obliged to clarify whether the contents of the delivered shipment are the prohibited goods specified below:

7.1.0

Packages whose contents, transport or storage violate a legal or official ban, in particular against import, export or customs regulations of the country of delivery, transit or destination. This also includes parcels or goods whose transport is not permitted under the Universal Postal Treaty.

7.1.1

Packages containing temperature-controlled goods that require special facilities, security measures or authorizations to be transported.

7.1.2

Packages whose contents could cause damage to property or injure people even during normal transport.

7.1.3

Packages containing live animals, animal carcasses, body parts or human remains.

7.1.4

Packages containing narcotics, intoxicants or prohibited substances

7.1.5

Packages containing money, precious metals, checks, credit cards, valid postage stamps, securities or other means of payment.

7.1.6

Packages whose contents violate intellectual property laws, including counterfeit or unlicensed copies of products (brand piracy of all kinds).

7.1.7

Packages containing weapons, especially firearms, or parts thereof, imitation weapons or ammunition.

7.1.8

MOROCCAN TRANS SERVICES LLC is not obliged to check the packages for the existence of transport exclusions; However, if such exclusions are suspected, it is entitled to open and inspect the packages. The sender is and remains the owner of the shipment and is consequently responsible for the content of his shipment.

7.1.9

Termination of the transport contract by the sender after the shipment has been handed over to MOROCCAN TRANS SERVICES LLC is excluded.

8.

Duties of cooperation and obligations of the sender:

8.1

The sender must provide largely complete and truthful information about his shipment, which enables clear assignment and identification even in the event of damage or in the event of return transport after undeliverability. The sender must pack his shipment in such a way that it is protected from loss or damage and that no damage occurs to MOROCCAN TRANS SERVICES LLC or third parties due to improper packaging.

8.2

The sender must enclose completely and truthfully filled out accompanying documents (customs content declaration, export permits, etc.) with his shipment. It is extremely important to observe the import regulations and customs regulations of the country of origin, transit and destination.

8.3

MOROCCAN TRANS SERVICES LLC is not responsible for the content of these papers. The sender is responsible for all consequences resulting from unauthorized shipment of goods abroad or from a violation of such regulations.

8.4

MOROCCAN TRANS SERVICES LLC assumes no liability for the content of the accompanying documents enclosed with the shipments. The sender is solely responsible for this and is also responsible for the consequences of non-compliance with these terms and conditions or a violation of Moroccan import regulations.

9.

Customs regulations.

9.1

Services from MOROCCAN TRANS SERVICES LLC :

9.1.0

MOROCCAN TRANS SERVICES LLC receives shipments, clarifies the necessary customs formalities, organizes transport and monitors the delivery of shipments in Morocco and USA by cooperating with partner companies.

9.1.1

Shipments to Morocco are handed over to our Moroccan partner company for further transport and delivery to the respective recipient in accordance with the regulations valid in Morocco for parcels and shipments. Compliance with a specific delivery deadline is not required.

9.1.2

MOROCCAN TRANS SERVICES LLC charges the recipient or sender a return shipping fee for the return of undeliverable shipments.

9.1.3

At the request of the sender or the recipient, MOROCCAN TRANS SERVICES LLC carries out inquiries into the whereabouts of packages. Corresponding research orders can only be submitted within a period of three months, starting on the day the package is delivered or handed in.

10.

Fee, freight, costs and payment conditions:

10.1

The prices for our services are net prices including statutory sales tax.

10.2

Unless otherwise agreed, the sender must pay the fee in advance and at the latest when the package is delivered. If payment by invoice or another payment method has been agreed in separate individual contracts, the invoice amount is due within two weeks of receipt without deduction. The sender can raise objections to the invoice amount within 30 calendar days of receipt; later complaints will not be taken into account.

10.3

The sender must reimburse MOROCCAN TRANS SERVICES LLC, in addition to the transport fee, for all costs incurred by MOROCCAN TRANS SERVICES LLC in the interests of the sender in connection with the transport of the package (customs duties, import and export duties, etc.). The sender releases MOROCCAN TRANS SERVICES LLC from all claims of third parties. The sender must also reimburse MOROCCAN TRANS SERVICES LLC for the costs that it incurs due to the return of his packages (if applicable, return shipping fees, packaging and storage fees, etc.).

10.4

In addition to the transport fee, the sender must bear any fees and additional costs paid by MOROCCAN TRANS SERVICES LLC that arise in connection with the customs clearance of his shipments.

11.

Liability:

11.1

MOROCCAN TRANS SERVICES LLC is only liable for culpable and improper fulfillment of contractual obligations as well as for loss, damage or theft of shipments and packages delivered in accordance with the contract only to the extent of the direct damage typical of the contract and only up to a certain maximum amount of 200 dollar.

11.2

MOROCCAN TRANS SERVICES LLC is exempt from any liability if the damage is due to circumstances that cannot be avoided even with the greatest care and whose consequences cannot be avoided (e.g. strike, force major, confiscation……..).

11.3

MOROCCAN TRANS SERVICES LLC is also exempt from liability for damages that are due to culpable or negligent behavior on the part of the sender, a violation of the sender's aforementioned obligations, or a violation of other legal exclusions of liability.

11.4

MOROCCAN TRANS SERVICES LLC is not liable for packages excluded from transport in accordance with the section on prohibited goods.

11.5

Claims for compensation are excluded if the sender has not submitted an inquiry request within a period of one month, starting from the day of delivery of his package.

11.6

The liability of the sender remains unaffected. The sender is primarily liable for damage caused to MOROCCAN TRANS SERVICES LLC or third parties from the dispatch of excluded goods in accordance with Section 7 or the breach of his obligations in accordance with Section 8.

12.

Shipments and packages insurance:

12.1

Shipments and packages not covered by insurance are:

12.1.0

Packages that are excluded from transport in accordance with the paragraph on prohibited goods.

12.1.1

Damage caused by missing or defective packaging or by the sender intentionally causing the damage.

13.

Other regulations:

13.1

The sender can neither assign nor pledge claims against MOROCCAN TRANS SERVICES LLC , with the exception of monetary claims.

13.2

The sender can only offset MOROCCAN TRANS SERVICES LLC claims against claims that have been legally established or are undisputed.

13.3

MOROCCAN TRANS SERVICES LLC is entitled to store, collect and process the data transmitted by the sender and recipient in connection with a shipment.

13.4

MOROCCAN TRANS SERVICES LLC is authorized to provide data to authorities and courts within the legally stipulated framework.

13.5

MOROCCAN TRANS SERVICES LLC is obliged to maintain postal secrecy and to comply with data protection standards in accordance with the applicable legal provisions.

13.6

All disputes in relation to the current contract are the exclusive jurisdiction of the New York state Courts of Law. These Courts of Law are expressly recognised and considered as the only competent jurisdictions.

14.1

The content and structure of the website are protected by copyright. Any reproduction of the information offered, and in particular any use of texts, parts of texts or images and sound material, requires the prior explicit and written consent of MOROCCAN TRANS SERVICES LLC.

14.2

Downloading, reproducing, distributing and transmitting (electronically or otherwise) or printing out individual pages or parts of this website for private, public or commercial purposes without the prior written consent of the management of MOROCCAN TRANS SERVICES LLC is strictly prohibited, and corresponding violations will be reported brought.
